Terms and Conditions

1. Registration for an examination, conclusion of contract

Registrations must be made in writing, including via e-mail or fax, by no later than 10 days before the examination date, signed as legally binding and with all requisite proofs. The registration is regarded as a binding order. The applicant thereby confirms that he is simultaneously entitled to act on behalf of third parties, provided he is not at the same time the contractual recipient of performance. By registering, the participant / orderer accepts the General Terms and Conditions of ISQI GmbH. The conclusion of the contract takes place following due registration and written confirmation of booking by iSQI GmbH. This may also be made by e-mail or fax.

2. Admission for participation in examinations

For admission to an examination and participation, the provisions of the respective subject-related and geographically competent testing board also apply. These can be viewed on the respective Internet page of the Board.

3. Data use, data protection

iSQI GmbH is entitled to process and to store the data submitted with the registration electronically, in compliance with the data protection legislation, solely for the purpose of the certification process and internal customer administration.

4. Terms of payment

The fee schedules of iSQI GmbH at the date of registration shall apply for the certification fees. All stated prices are net prices and subject to statutory value added tax. The invoice must be settled immediately and without any deduction. Any expenses for travel, overnight accommodation, meals and other costs are – unless they are an agreed price component for the examination concerned – payable by the participant or client himself.

5. Certification examinations

Participants will be notified in writing or by e-mail of the date of the respective certification examination and this date is binding, subject to further regulations in these provisions, once the booking has been confirmed (see Point 1.).

6. Certification examination procedure

Please obtain information about the precise procedure for the respective certification examination in advance, on our website, by e-mail, by post or by contacting our certification department directly by telephone.

7. Examination review

Up to 30 days after communication of the examination result, each participant has the right to make an application to review his examination. Examinations which have taken place in Germany may only be reviewed at the business premises of ISQI GmbH. An administration fee of €60.00 will be charged for the review. In the case of paper-based examinations, a target-performance comparison of the original question paper with the answer sheet will be made. A member of staff of iSQI GmbH is present throughout.

In the case of a review of E-Exams, the printed, detailed result of the participant with a print-out of the examination questions used at Pearson VUE at the time of taking the examination will be provided. The review procedure shall take place in similar fashion to the provisions for paper-based examinations.

In the case of examinations which have taken place outside Germany, iSQI GmbH will endeavour to facilitate a review in the country where the examination was taken. There is no legal right to do so.

8. Services

The fees for our certification examinations include the following services of iSQI GmbH:

- provision of the room, if not organised by a training provider
- provision of examination documents
- induction by a member of staff trained by iSQI GmbH and subject to an obligation of confidentiality

For examination participants who require additional aids or additional processing time because of a proven physical impairment, special agreements can enter into force on request, which are set by the respective testing board.

9. Withdrawal / cancellation

Cancellations must be notified and/or submitted in due time before the examination date in writing, by fax or e-mail. There is no charge if they are received at ISQI GmbH no later than 7 days before the examination date (00:00 am). Proof of due cancellation within the meaning of these provisions is the responsibility of the applicant / participant. The full fee for the booked examination will remain payable for any cancellations at a later date, or in case of non-attendance. We reserve the right to cancel certification examinations at short notice, especially if the number of participants is less than 6 persons for the respective date. In this case, the participant is entitled to withdraw from the contract free of charge. At the same time, ISQI GmbH shall endeavour to book the orderer / participant a replacement appointment at the next available date. No further claims will be accepted.

iSQI GmbH can decide case by case and only on application whether it will allow the exchange of a participant or the re-scheduling of an exam. Should this be the case the primarily registered participant will be charged with a handling fee of 60,00€.

10. Force majeure

In the event of the cancellation of a certification examination due to the illness of the staff member of iSQI GmbH, force majeure, or other circumstances and events beyond the control of iSQI GmbH, there is no entitlement to implementation of the event. In such cases, iSQI GmbH has no obligation to reimburse travel or accommodation costs or loss of working time. If the certification examination is cancelled, the customer / participant will be informed at once. If the event is rescheduled, the right to reimbursement remains in effect.

11. Liability

iSQI GmbH is liable only in cases of intent and gross negligence. This restriction does not apply for losses on the basis of the breach of contractual obligations, which result from a malicious deception or which result from an injury to life, limb or health. The right to claim compensation in lieu of performance is not affected. In the case of gross negligence or intent, iSQI GmbH shall be liable for all losses in full. For the rest, the right to compensation is limited to foreseeable losses in accordance with standard contractual conditions. Claims for compensation against iSQI GmbH become time-barred after 12 months from the date of origin, unless they are based on unauthorised or deliberate action. The limits and exclusions of liability agreed under this contract also apply for the personal liability of the representatives, employees and vicarious agents of iSQI GmbH.

12. Copyright

The documents issued for the purposes of the examination are subject to copyright. It is unlawful to use them in infringement of copyright.

13. Safety

All participants in examinations are obliged to comply with the house rules and all safety provisions in force at the site of the event.

14. Electronic Examinations

Electronic examinations held by partners of iSQI GmbH are not subject to the domain of application of the terms and conditions of iSQI GmbH, but to those of the respective organiser.

15. Other provisions

Additional or divergent agreements, alterations and additions to these terms and conditions must be made in writing. Should any individual provision of these general terms and conditions of business be invalid, this shall not affect the validity of these general terms and conditions of business. Place of performance and jurisdictional venue is Potsdam.
